Are Lawyers Ethical?

By Lance Winslow Many believe that Lawyers are not ethical human beings and that they do not enforce the law or protect the rights of our society. Many believe that lawyers merely use the law and re-interpret the law for the advantage of those paying them to do so. Therefore they are being unethical to the law the purport to serve, as they manipulate the law to mean whatever it is that they wish it to mean for the highest paying clientele. Now some would argue that they are ethical and helping their clients from being abused by law. Yet if so they are not enforcing the law, but modifying either its intent, definition or letter of the law using case law and arguments which are vaguely relevant to any particular reality of the law. So when arguing the question are Lawyers Ethical, one would have to come to the conclusion that they are pragmatic at best and outright criminals at worst. Yet any lawyer worth his salt will immediately object to such statements and say ask the questions; What do you mean when you say Ethical? What is your definition of Law? What do you consider a definition? What exactly is a client? What exactly is reality? What do you mean by the comment of pragmatism? This is how a lawyer can justify their criminality or decisions to hide in the shawdows of the gray area of law and proclaim themselves members of a noble and ethical profession and slayers of evil as they enforce the laws for the betterment of the whole of our civilization. Of course all their talk and boloney is pure and utter hokum, but it is nice to know where they are coming from as the refute Caesars best advice; the first thing we do is kill all the lawyers! In fact if lawyers were as ethical as they say, we would not have to kill them, as they would kill themselves to save our civilization from their obvious attacks on the truth and our laws. Provide a Quiet Retreat for Your Overnight Guests

But even with the best of relationships, your guests (and you) are going to need some quiet time away from each other. Turning your guest room into a haven filled with the essentials and a few luxuries will go a long way toward providing your guests with an enjoyable stay. Your guest room should be quiet, clean, and attractive, and be cool in the summer and warm in the winter. A CD player with CDs representing your guests favorite style of music will be welcomed, as will a collection of favorite books and magazines. Extra blankets for cold weather sleeping can be draped over the bed or a chair in the room. Make sure you have on hand some basic food items. A mini-fridge with spring water, juices, or teas will be welcome, as will a stock of granola bars, crackers, jams or cheeses. A basket of fresh fruit is another healthy addition to your guest room. Add a few luxurious touches, like some gourmet chocolates, to make your guests feel really pampered. For cooler weather, have a way for your guests to heat up water or milk for hot chocolate or tea, and be sure to provide the ingredients. A steamy cup of gourmet hot chocolate on a cold night will be e memorable event! Make it easy for your guests to provide for their own needs. Make sure theyve got plenty of towels, facecloths, soaps, and lotions for their own personal care. You might even want to provide a bathrobe like some hotels do, in case they forgot to pack their own, and some new terrycloth slippers. Toothpaste and toothbrushes in their original packaging may save you or your guests a trip to the nearest drugstore. Providing your guests with their own space within your house, and making it easy for them to meet their own personal needs while they are visiting you, will ease the stress that sometime comes with housing people overnight, and will add to the enjoyment of the visit, for them and for you. Changing Routines

By Robert Charlton The biggest challenge I faced when I decided to lose weight was in changing my routines. First, I had to become very aware of how much food I was putting in my body. Then I had to consciously put less food into my body. It sounds simple, but routine is a harsh mistress. I did not realize that I ate all evening long while watching television. I had a little table next to my favorite chair and it held a variety of treats. I knew I would not be successful if I tried to remove all the treats cold turkey. So I started by setting myself a curfew. I picked a time in the evening beyond which I would not eat. Then, after several evenings where I proved to myself that I have enough self discipline to meet my own curfew, I moved the curfew up an hour. I discovered that I dont need to eat all evening long. It was just a habit. The next technique I came up with was to adopt a different attitude toward eating. In the past I would eat until I felt full. Unfortunately there is a time lag that will permit you to eat too much before you realize it. My new attitude was to only eat until I was no longer hungry. I started off by eating only half of what I would normally eat at lunch time. Then I would wait five minutes and evaluate the condition of my stomach. If I was honest with myself I would have to admit that I was no longer hungry and stop eating. Now the half size portion is my new standard size lunch. I really dont think that crash diets are a good idea. Temporarily depriving yourself of all the foods you enjoy eating may provide short term results, but its not something that can be sustained. I firmly believe that I will be successful at maintaining a reasonable weight because I still eat all my favorite foods. I just dont eat as much of them as I did before. Just be sure to take some vitamins because you wont be eating enough food to provide all the nutrients you need. And be prepared for slow but steady progress. Rome wasnt built in a day, and you wont reach your ideal weight in a day. But by changing your routines and your attitude toward eating, you will be getting more control over your life. Lengthy Franchise Agreements and Disclosure Documents; Why?

By Lance Winslow Most franchise buyers complain about the lengthy franchise agreements and disclosure documents. Of course there are two reasons for this; 1.) There is over regulation in the Franchising Industry, which requires this and; 2.) There is so much litigation, over lawyering and case law that a franchisor must protect them selves. Nevertheless nearly all franchise buyers say; These Lengthy Franchise Agreements and Disclosure Documents; Why? Yes well they are too long and most franchise agreements do go to extreme in the terms of lengthness, however consider that if they remain vague then the franchisee loses more. Contracts which refer everything back to the confidential operations manual, which many times the franchisee hasnt yet seen at the time of the agreement are vague and the more which is actually spelled out in advance in the actual agreement is better for the franchisee. In my opinion not worse off, as it gives the franchisee/buyer more chance to read into the document. Since the franchise agreements are in plain English, which is good and fair, the more that is spelled out the better thus making it more lengthy. The Franchise Disclosure Documents should be a 3-page form that you hand to the franchise buyer with the actual franchise agreement, that would reduce the number of pages of the disclosure documents by way over two-thirds.
